Welcome to the KES Membership Program (“Membership”), offered by KES Original (“KES,” “we,” “our,” or “us”). By enrolling or participating in this Membership, you agree to the following Terms and Conditions (“Terms”). Please read them carefully before joining.

1. Membership Eligibility

The KES Membership Program is open to individuals aged eighteen years or older who provide a valid email address. Enrollment is free and is available exclusively through KES Official Channels, including our official website and authorized pop-up stores. Membership is strictly personal and non-transferable. KES reserves the right to decline applications or terminate accounts at its sole discretion if fraudulent activity, abusive behavior, or misuse of the program is suspected.

2. Membership Tiers and Qualification

The KES Membership Program offers five distinct tiers: N Member, S Member, E Member, K Member, and The KES Member. Tier qualification is based on cumulative spending across KES Official Channels. As your total spending increases, you unlock higher-tier benefits, including accelerated point earnings, exclusive discounts, bonus event eligibility, and access to complimentary replacement requests. KES reserves the right to adjust the qualification thresholds, modify benefits, or amend program rules with prior notice to ensure fairness and maintain service quality.

3. Points and Rewards

KES Points (“Points”) are earned on qualifying purchases made through KES Official Channels. The rate at which Points are earned depends on your membership tier, starting from five points per one US dollar spent and increasing up to twenty points per dollar at the highest tier. Points can be redeemed on KES Official Channels as specified in promotional materials. Points are non-cash, non-transferable, and cannot be exchanged for currency. Expired, revoked, or unused Points cannot be reinstated under any circumstances. Unless otherwise stated, Points remain valid for twenty-four months from the date they are earned.

4. Complimentary Replacement Benefit

KES offers a Complimentary Replacement Benefit for eligible members. The number of replacement requests you may submit each month and the maximum MSRP of eligible items depend on your membership tier. Each product (SKU) is eligible for only one replacement request during its lifetime and cannot be replaced multiple times. Replacement requests are available within six months of purchase, and exclusively for purchases made through KES Official Channels and are subject to approval based on the condition of the returned item and other program rules. Customers need to ship old pieces for inspection when submitting any requests. Intentional damage, alterations, and misuse will disqualify items from replacement eligibility.

The first replacement request for each order includes complimentary outbound shipping. For additional requests within the same month, outbound shipping fees are the responsibility of the customer. International duties, customs, and taxes are excluded from this benefit and must be paid by the customer. KES reserves the right to decline replacement requests at its sole discretion.

5. Discounts and Promotions

Exclusive discounts and promotions are offered to members based on their tier status. Discounts are applied only to qualifying products or orders, as specified in program communications, and cannot be combined with other promotions unless explicitly stated. KES reserves the right to amend or withdraw promotions at any time without prior notice.

6. Program Changes and Termination

KES may amend, suspend, or terminate the Membership Program at any time. If the program is terminated, all unused Points, replacement requests, and member-exclusive benefits will immediately expire. Continued participation after updates or amendments constitutes acceptance of the revised Terms.

7. Limitation of Liability

KES is not responsible for unauthorized use of Membership accounts, loss of Points caused by fraudulent activity, or delays related to third-party carriers or logistics providers. To the fullest extent permitted by law, KES disclaims liability for any indirect, incidental, or consequential damages arising from participation in the Membership Program.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of California, USA. Any disputes related to the Membership Program will be resolved exclusively in the courts of California.

KES Complimentary Replacement Terms and Conditions

The KES Complimentary Replacement (“Replacement Policy”) is an exclusive benefit offered to members of the KES Membership Program. By requesting a complimentary replacement, you agree to comply with the following terms and conditions.

1. Eligibility

Complimentary replacement is available only for items purchased directly through KES Official Channels, which include our official website and any authorized KES pop-up stores. Purchases from unauthorized retailers or third-party platforms are not eligible. Eligibility for complimentary replacement depends on your KES Membership Tier and the corresponding MSRP limit for that tier.

2. Replacement Requests and Limits

Each membership tier offers a different number of monthly replacement requests and an MSRP limit that defines the maximum eligible value for replacement. Depending on your membership tier, you may request between one and three complimentary replacements per month. Each individual product (SKU) is eligible for one replacement request only, and this cannot be exceeded under any circumstances. Replacement is only available within 6 months of purchase.

3. Condition Requirements

All replacement requests are subject to an inspection and approval process. To qualify for a complimentary replacement, the item must be in reasonable, wearable condition. Products with intentional damage, significant stains, tears, alterations, or other signs of misuse are not eligible for replacement. KES reserves the right to evaluate the condition of returned items and decline requests at its sole discretion.

4. Request Process

To initiate a replacement, you must submit a request via your KES Membership Account. You will be asked to provide your order details and the reason for the replacement. Once your request is approved, you will receive instructions on how to return the original item. The replacement will be shipped after we receive and inspect the returned product.

5. Shipping and Duties

The first replacement request for each order includes complimentary outbound shipping provided by KES. For any additional replacement requests made within the same month, all shipping fees are the responsibility of the customer. For international orders, duties, customs, and taxes are not covered under the Complimentary Replacement Policy and must be paid by the customer.

6. Abuse Prevention and Enforcement

KES actively monitors replacement activity to protect the integrity of the Membership Program. Abuse of this benefit, including excessive replacement requests, reselling replacement items, or creating multiple accounts to bypass limitations, is strictly prohibited. Any suspected abuse will result in immediate action, which may include temporary suspension of replacement privileges, permanent revocation of membership benefits, or termination of your KES Membership.

7. Exclusions

Complimentary replacement does not apply to final-sale items, custom or personalized products, gift cards, or purchases made through unauthorized channels. These products are excluded from all replacement benefits, regardless of membership tier.

8. Policy Changes

KES reserves the right to modify, suspend, or terminate the Complimentary Replacement Policy at any time without prior notice. In the event of any changes, updated terms will be posted on the official KES website, and continued participation constitutes acceptance of the revised policy.
